Amazon Prime accused of misleading Prime members

Amazon is facing a complaint alleging that the company misled Prime members by charging more for ad-free movie and TV streaming. The case has been filed for consumers who saw their membership conditions changed when Amazon shifted to make its ad tier the default for over 100 million subscribers.

The complaint also alleges infringement of state consumer protection laws and breach of contract. Since Amazon adjusted, the service has become the biggest ad-supported subscription streamer and a streaming powerhouse.

Allegations of fraudulent behavior

When it changed the conditions of yearly memberships, impacting customers who had already paid for the service, Amazon came under fire for allegedly engaging in fraudulent behavior. According to the lawsuit, Amazon deceived customers and fair competitors by falsely marketing Prime Video as “commercial-free” for years before introducing its ad-supported tier.

On behalf of consumers who joined Prime before December 28, 2023, the proposed class action seeks at least $5 million and a court order prohibiting Amazon from engaging in additional fraudulent behavior. Amazon was sued by the Federal Trade Commission last year for allegedly tricking customers into subscribing to its Prime program and preventing them from canceling their memberships.
